The Consensus Process
You and your spouse attend an initial information meeting that will provide us with a better understanding of you and your family and give you a better understanding of our process. This information meeting is similar to a consultation, and costs $300. Based on the information obtained during that meeting, we will decide who of our professionals is best suited to help your family. Of course, your input in considered and if there is a particular professional you want to work with, you will have that choice.
During an approximately two-hour meeting, you and your spouse will individually meet with your respective lawyers. Then, one of you will meet with the joint financial specialist, while the other meets with the family transition expert. You will switch roles to ensure each of you has time with both the family expert and financial specialist. Following these meetings, the professionals will confer to determine the best way forward for your family. Afterward, we will assess the overall cost of the process and, if you decide to proceed, we will enter into a contract. This contract will establish guidelines to reduce stress and uncertainty, such as agreeing not to engage in unusual financial transactions or make unilateral changes regarding the children.
During this phase, which can last several weeks, you will work with the family transition expert on goal setting, emotional and family readiness and co-parenting strategies. In a process guided by the joint financial specialist, you and your spouse will exchange financial information and documents to disclose all assets and liabilities. The financial specialist will insure complete disclosure and a rigorous analysis. If child support or alimony is at issue, sources and explanations of income are included.
During this phase, we will arrange settlement and negotiation meetings customized to your family’s needs. These meetings will involve your entire support team and prioritize the issues most important to you. With your lawyer present, you will be well-informed about the topics and resolutions we will address in advance of each meeting. The pace of this process will be determined by your comfort level. We will hold as few or as many meetings as necessary to resolve all divorce matters. The phase concludes with the drafting and signing of a marital settlement agreement and/or parenting plan.
Once you have resolved all issues, the lawyers will draft the necessary documents for your legal divorce which will occur relatively quickly since it will be an uncontested matter. There will be a filing fee paid to the court to file the court documents.
