What Is Collaborative Divorce?

Collaborative Divorce is a voluntary, out-of-court process that allows couples to work together — rather than against each other — to create a mutually agreeable resolution. Each person has their own attorney, and together, you assemble a team that may include a neutral financial expert and a mental health facilitator to guide the emotional and communication aspects of the process.

The result? Less stress. More control. Better outcomes — especially if you have children.

How Collaborative Divorce Works

Here’s what to expect from a Collaborative Divorce process:

  1. You and your spouse agree not to go to court. Everyone signs a participation agreement committing to collaboration and transparency.
  2. You each retain a collaboratively trained attorney. These lawyers are not your opponents — they’re problem-solvers.
  3. You build a team. A neutral financial expert helps organize assets and future planning. A mental health professional (the facilitator) supports effective communication and emotional stability.
  4. You meet together in joint sessions. The focus is on respectful dialogue and practical solutions, not blame or revenge.
  5. You create a tailor-made agreement. That includes parenting plans, asset division, support terms — all on your timeline, not the court’s.
